PCC Freemind Terms of Service
These Terms of Service (“Terms”) govern your use of the PCC Freemind mobile application (“App”). Please read these Terms carefully before using the App.
1. Acceptance of Terms
By creating an account or accessing the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the App.
2. Services Description
PCC Freemind provides a platform that connects users (“Youths”) with independent, qualified professionals (“Counselors”) for guidance and support in the areas of hygiene, mental health, and social life.
3. User Accounts
- You must be at least 13 years old to use the App. If you are under the age of 21 (the age of majority in Cameroon), you represent that you have received permission from a parent or guardian to use this service.
- You are responsible for maintaining the confidentiality of your account login information.
- You agree to provide accurate and complete information and to update it as necessary.
4. Counselor Relationship
- Counselors are independent professionals, not employees or agents of PCC Freemind.
- The App provides a platform for communication but does not directly provide medical or therapeutic services.
- Not a Medical Service: PCC FREEMIND IS NOT INTENDED FOR MEDICAL OR CRISIS situations. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL DIAGNOSIS, TREATMENT, OR THERAPY. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, A MENTAL HEALTH CRISIS, OR THOUGHTS OF SUICIDE OR HARM, PLEASE IMMEDIATELY CONTACT CAMEROON EMERGENCY SERVICES (by calling 112) OR GO TO THE NEAREST HOSPITAL.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose as defined by the laws of the Republic of Cameroon.
- Harass, abuse, defame, or harm another user or counselor.
- Impersonate any person or entity.
- Upload or transmit any content that is harmful, abusive, hateful, obscene, or illegal.
- Attempt to gain unauthorized access to any part of the App or its systems.
6. Intellectual Property
All content, features, and functionality of the App (including text, graphics, logos, and software) are the exclusive property of PCC Freemind or its licensors and are protected by copyright and other intellectual property laws.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. PCC FREEMIND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY CAMEROONIAN LAW.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PCC FREEMIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
9. Indemnification
You agree to indemnify and hold harmless PCC Freemind and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or your violation of these Terms.
10. Termination
We may suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, our counselors, or our platform.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of [e.g., the Court of First Instance in Yaoundé, Cameroon].
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of changes by updating the “Last Updated” date. Your continued use of the App after any change constitutes your acceptance of the new Terms.
